Acceptance and eligibility

These Terms of Use and End User License Agreement (the “Terms”) form a binding agreement between you and TradesChart (“TradesChart,” “we,” “us,” or “our”) governing the TradesChart website, applications, data displays, and related services (collectively, the “Service”).

By accessing the Service, creating an account, selecting an “I agree” control, or submitting information, you agree to these Terms and acknowledge our Privacy Notice. If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter a contract. If you act for an organization, you represent that you can bind it.

What TradesChart provides

TradesChart organizes user-reported home-service quotes and paid prices into local, comparable market information. Results may include aggregates, ranges, medians, sample sizes, confidence indicators, and contextual descriptions.

Prices are historical or reported observations—not offers, appraisals, bids, professional advice, or promises of what any job should cost. Actual prices vary with scope, materials, timing, property conditions, permits, location, contractor qualifications, and other factors. You remain responsible for investigating providers, reviewing contracts, confirming licenses and insurance, and making your own hiring and payment decisions.

TradesChart does not hire, supervise, recommend, endorse, or guarantee contractors and is not a party to any agreement between you and a service provider.

Accounts and security

You must provide accurate, current information and keep your credentials confidential. You are responsible for activity under your account and must promptly report suspected unauthorized access. You may not impersonate another person, create accounts through automated means, or use another person’s account without permission.

Email accounts must be verified before submitting prices. We may require additional verification, limit activity, or suspend access to protect users, data integrity, or the Service.

Your license to use the Service

Subject to these Terms, TradesChart grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for lawful personal or internal business purposes. No ownership rights are transferred. Rights not expressly granted are reserved by TradesChart and its licensors.

Your submissions and the pricing-data license

You retain ownership of content you submit, including job descriptions, prices, notes, and supporting materials (“User Content”). You represent that your User Content is truthful to the best of your knowledge, relates to a genuine quote or transaction, and that you have the rights and permissions necessary to provide it.

You grant TradesChart a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, secure, review, reproduce, normalize, classify, redact, analyze, modify, and create derivative works from User Content to operate, protect, improve, and promote the Service.

For submitted job and pricing information, that license also permits TradesChart to de-identify, aggregate, combine, publish, distribute, commercialize, license, and sell market-data products and insights. This includes approved pricing records retained after account deletion once direct identifiers, receipts, private notes, contractor names, exact ZIP codes, and the link to your account have been removed. This license survives account closure to the extent necessary for those de-identified records, aggregates, existing publications, backups, legal compliance, and enforcement of these Terms.

We do not promise that de-identification eliminates every re-identification risk. Public and commercial data products should use grouping, minimum sample thresholds, or similar safeguards to avoid exposing individual households or unusually specific transactions.

Receipts and private evidence

Receipts and invoices are private supporting evidence for review; they are not part of the public market dataset. You authorize TradesChart and its service providers to store, secure, inspect, redact, and process them only to verify submissions, prevent abuse, resolve disputes, comply with law, and operate the Service.

Before uploading, remove information that is unnecessary for verification, including payment-card numbers, bank information, medical information, access codes, and another person’s sensitive data. Do not upload a document you lack permission to share. Receipt handling and deletion are described further in the Privacy Notice.

Acceptable use

You may not:

• submit fabricated, misleading, duplicative, manipulated, or unlawfully obtained information;
• coordinate submissions or other activity to distort a market, target a business, or mislead users;
• scrape, harvest, crawl, bulk-download, mirror, resell, or build a competing dataset from the Service without written permission;
• reverse engineer, probe, bypass, disable, or interfere with security, rate limits, moderation, access controls, or technical restrictions;
• upload malware or use bots, scripts, or automated accounts without written permission;
• infringe intellectual-property, privacy, publicity, confidentiality, or other rights;
• harass, defame, threaten, discriminate against, or unlawfully identify any person; or
• use the Service in violation of law or for fraud, spam, or unauthorized solicitation.

Review, moderation, and enforcement

We may review, classify, redact, reject, remove, or decline to publish any submission. Approval means only that a submission passed our current review process; it is not a guarantee that every detail is accurate. We may investigate suspected abuse and preserve or disclose information when reasonably necessary to protect the Service, enforce these Terms, respond to legal process, or prevent harm.

We may suspend or terminate accounts or access for violations, risk, prolonged inactivity, legal requirements, or discontinuation of the Service. You may stop using the Service or delete your account as described in the Privacy Notice.

Availability and warranty disclaimers

To the maximum extent permitted by law, the Service and all content and data are provided “as is” and “as available.” TradesChart disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, availability, security, and results.

We do not warrant that data is error-free, representative, current, or suitable for your situation; that the Service will be uninterrupted or secure; or that defects will be corrected. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

Limitation of liability

To the maximum extent permitted by law, TradesChart and its owners, affiliates, personnel, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or opportunities; property damage; personal injury; or losses arising from contractor selection, pricing decisions, User Content, unauthorized access, or inability to use the Service.

Our total liability for all claims arising from or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid TradesChart for the Service during the 12 months before the event giving rise to the claim or (b) US $100. These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be excluded.

Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless TradesChart and its owners, affiliates, personnel, and service providers from third-party claims, damages, liabilities, losses, and reasonable costs arising from your User Content, your misuse of the Service, your violation of these Terms or law, or your infringement of another person’s rights. We may control the defense of a covered claim, and you agree to cooperate.

Disputes

These Terms are governed by applicable law, without regard to conflict-of-law principles. Any dispute must be brought in a court with lawful subject-matter and personal jurisdiction unless the parties agree otherwise or applicable law provides another forum.

Before filing a claim, you and TradesChart agree to attempt in good faith to resolve it informally for at least 30 days after written notice. These Terms do not require arbitration and do not waive rights that cannot lawfully be waived.

Changes and general terms

We may change the Service or these Terms. Material changes will be posted with a new effective date and, when appropriate, presented for renewed acceptance. Continued use after updated Terms take effect means you accept them, except where law requires additional consent.

If any provision is unenforceable, it will be narrowed to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, financing, reorganization, sale, or transfer of the Service. These Terms and incorporated policies are the entire agreement concerning the Service.

Sections that by their nature should survive—including data licenses, intellectual property, disclaimers, liability limits, indemnification, dispute terms, and general provisions—survive termination.
